The facilities management sector is large and complex and is valued at over 396 billion per annum.

 

Facilities management as a discipline includes what are known as "soft" services (cleaning, catering, janitorial reception, security, portering, waste management, helpdesk etc.) and "hard" services (building and fabric maintenance, building management systems (BMS), energy and utility management, space planning, asset and lifecycle management).

 

The McGrigors Facilities Management Team (the "Team") has been actively involved in the facilities management sector for many years. The Team is headed up by Victoria Miller who has worked in the sector since 1998 and is a member of the British Institute of Facilities Management.

 

As a result of its vast experience in this sector, the Team understands not only the key legal issues faced by facilities management companies but also the everyday commercial and practical issues including areas such as benchmarking and market testing, variation of contracts, lifecycle, performance mechanisms and achieving objective service specifications. Through their involvement on over 140 PFI/PPP projects which have reached financial close, the Team are well placed to advise on the many operational issues arising in existing PFI/PPP, infrastructure and outsourcing projects. Excellent legal and practical advice is provided by the Team who are renowned for their ability to identify and manage risks as well as focusing on the key commercial issues for their clients.

 

Primarily the Team advises employers, special purpose companies, and funders on major infrastructure projects, across sectors such as education, healthcare, roads and transport, leisure, hospitality, accommodation and regeneration. The Team has also advised the public sector in relation to the outsourcing of facilities management contracts. All aspects of facilities management work and outsourcing projects are handled by the Team across a broad range of sectors and industries.

 

The Team provides a complete service to clients including:

  • advising on the relevant procurement process to be adopted, including EU Procurement Law procedures;
  • drafting and reviewing legal aspects of tender documents, including standard or bespoke contracts and heads of terms;
  • negotiating contracts;
  • analysing risk pass through management and mitigation;
  • reviewing the performance mechanisms, lifecycle;
  • provisions and efficiency improvements;
  • negotiating interface issues with other subcontractors;
  • negotiating dispute resolution procedures and exit strategies; and
  • provision of advice throughout the life of the contract, including any variations
