Public Law

From urgent advice to long-term partner, our role ranges from providing opinions on specialist points of law to more active participation in larger multi-disciplinary project teams. The service we provide is dictated by your requirements. The experience and expertise we possess enables us to be quick and flexible in responding to your varied needs.

Our clients include government, local authorities, development agencies, housing authorities, public trusts, NHS trusts, and other public sector bodies as well as private sector companies. We work with clients to deliver practical solutions to difficult questions. We are sensitive to the balancing act that is modern governance. Our services are tailored to assist you in delivering public services whilst delivering best value in innovative ways which offer solutions and practical working conditions for those at the coal face.

Our service includes:

  • Statutory interpretation - e.g. to assess the competency of powers or of a decision.

  • Defending a challenge in response to a public sector decision.

  • Assisting with the formulation of policy within a legal framework governed by UK, Scottish, and/or European Law.

  • Advice - to public and private sector clients - we help our client negotiate legal difficulties encountered in Strategic Partnership Arrangements, to ensure that service delivery remains on track and that good working relationships between the public and private sector are preserved.

  • Transport and Infrastructure Project advice - assisting our public and private sector clients to plan and negotiate a web of law to determine which statutory consents, local legislation, privately promoted legislation, European legislation (State aid, European Funding, Procurement), planning processes and environmental consents will be required or involved in order to get the project started. Thereafter we work alongside our client to ensure any legal obstacles which threaten progress are neutralised.

  • Advice on compliance programmes for the public sector e.g. under Freedom of Information, Data Protection, or European Procurement regimes.

  • Helping you to participate in the Scottish Parliamentary process e.g. submitting objections to a private bill before the Scottish Parliament to ensure that your interests are represented and protected.
