Joanne is a partner in the litigation & dispute resolution team and is based in our Glasgow office. She is a Solicitor-Advocate entitled to appear in the Court of Session, House of Lords and Privy Council. Joanne has considerable advocacy experience in both the Sheriff Courts and the Court of Session. She is dual qualified in English and Scottish law, having spent a number of years working in our London office. Joanne is part of the contentious corporate and insolvency team, and has extensive experience dealing with a wide variety of general commercial disputes, including high profile and complex litigation. Joanne also has experience of advising on alternative forms of dispute resolution, including mediation.
Recent Successes:
- advising and conducting the advocacy at a 3 week proof in relation to a complex unfair prejudice claim for the minority shareholder in an oil services company in Aberdeen
- advising and conducting the advocacy for a large UK retailer in relation to termination of a logistics contract, securing recovery of assets withheld unlawfully at the date of termination alleged to be subject to lien, and defending proceedings raised following termination and preparing a detailed counterclaim
- advising and conducting the advocacy on behalf of a major energy supplier in defending a multi-million pound claim in the Court of Session in respect of commercial agency regulations
- advising a joint venture company in relation to a protracted dispute about recovery of development costs of an aborted scheme, including arguments on commercial interpretation and rectification
- advising a national retailer and conducting the advocacy at proof in relation to an action for repetition of sums paid in error
- advising a major real estate investment company in a multi-million pound claim in the Court of Session arising from alleged breach of an exclusivity clause and advising on third party claims for professional negligence
- advising a construction company on alleged failures by a surveyor in relation to service delivery and performance, and conducting the proof
- advising a recruitment agency in relation to a software dispute against a service provider; successfully settling the matter out of court in a quasi-mediation
- advising a plc in relation to a claim for enforcement of missives, including advice on specific implement, exposure on damages and a claim for professional negligence
- advising and conducting the advocacy in defence of a claim for enforcement of "penalty" clauses in missives; successfully defending the action at debate and negotiating and settling with recovery of expenses
- advising the director of a building services company in relation to a health and safety prosecution and preparing for a 4 week trial in Dundee Sheriff Court following a fatality
- acting for a major international oilfield service company in relation to an investigation and potential prosecution by the Environment Agency
- acting for a national retailer in a prosecution arising from alleged failings under the Fire (Scotland) Act
- advising in relation to a complex and high value property dispute arising from contaminated land clean up costs
- advising and acting on behalf of clients in a wide range of commercial litigation proceedings, including enforcement of contract terms, insolvency proceedings, professional negligence, agency, interim interdict and interdict proceedings and recovery of commercial debts
