A case brought by McGrigors in relation to the entitlement of taxpayers to claim compound interest on overpaid VAT has been transferred (with the agreement of all the parties to the appeal) from the First-tier Tribunal to the new Upper Tribunal to be heard there in the first instance. We have been informed that this is the first case to be referred under this new procedure for transfer of complex cases in the new Tax Tribunals structure, which came into force on 1st April 2009. The case is referred to informally by HMRC as the "Compound Interest Project".
The appeals are related to similar proceedings brought in the High Court under a group litigation order known as the "VAT Interest Cars" GLO, the first GLO to progress through the Courts in relation to VAT. For details please click here.
