Bribery & Corruption - Managing International Risk
- The British bridge supplier, Mabey & Johnston was recently fined £6.6m for corruption and sanctions violations, and its Managing Director has been charged, by the SFO;
- The CEO of Kellog Brown & Root was imprisoned for 7 years;
- Siemens was fined £1.4bn by US and German authorities;
- BAe Systems is facing prosecution and a potential £1bn fine. A former agent of BAe has been charged in connection with defence contracts between BAe Systems plc and certain countries in Eastern/Central Europe.
What did they do wrong? How did the authorities find out? What lessons can be learned? How should we remunerate overseas agents? Are facilitation payments allowed? What amounts to "adequate procedures" to prevent corruption?
These and other questions will be explored.
Anti-corruption enforcement is becoming increasingly global. In particular US and UK officials have become more proactive in combating corruption. The UK Bribery Bill when enacted will strengthen the UK anti -corruption regime and will give UK officials equal, and in some instances, greater, powers than the US Foreign and Corrupt Practices Act to combat corruption. Despite the risks to companies, their management and employees many companies have not put in place procedures to manage these risks, or, where procedures have been put in place, they have not been revised to comply with current best practice guidance.
The seminar will focus on how your company may be exposed to the anti -corruption regime and how such risks can be managed including discussion of:
- the key elements of bribery offences under US and UK legislation
- some compliance basics
